Privacy Policy

1. Information We Collect

Information you provide directly:

• Account information. Name, email address, password, and profile details you provide when creating an account.
• Program content. Responses, reflections, goals, and other content you submit while participating in our programs.
• Payment information. Payments are processed by Stripe, our payment processor. We do not store your full credit card number; we receive limited information such as the last four digits of your card, card type, and transaction details.
• Phone number and SMS opt-in. If you opt in to receive text messages, we collect your mobile phone number and a record of your consent.
• Communications. Information you provide when you contact us, respond to surveys, or subscribe to our emails.

Information collected automatically:

• Usage and device data. IP address, browser type, device information, pages visited, time spent, referring URLs, and similar analytics data, collected via cookies and similar technologies through Google Analytics and PostHog.

2. How We Use Your Information

We use your information to:

• Provide, operate, and improve the Services, including delivering daily program content, exercises, and reflection prompts
• Personalize your program experience, including using AI technology to tailor questions, content, and action items to your responses
• Process payments and manage your subscription or program enrollment
• Send you text messages related to your program, if you have opted in (see Section 4)
• Send transactional emails (e.g., receipts, account notices, program delivery) and, with your consent, marketing emails
• Analyze usage of the Site to improve our content and Services
• Detect, prevent, and address fraud, security issues, and technical problems
• Comply with legal obligations

3. AI-Powered Personalization

Portions of our programs use artificial intelligence to personalize your experience. When you participate in a program, your responses and reflections may be processed by third-party AI service providers on our behalf to generate personalized questions, content, and action items. These providers process your information solely to provide services to us, and we do not permit them to use your program content to train their models except as required to deliver the service. We recommend you avoid submitting sensitive personal information (such as health or financial details) in free-text program responses.

4. SMS/Text Messaging Program

If you opt in to our text messaging program, we will send you SMS messages related to your program, such as daily exercise reminders, program content, and reflection prompts.

• Consent. By providing your mobile phone number and opting in, you consent to receive recurring automated text messages from Elevate Coaching at the number provided. Consent is not a condition of purchase.
• Message frequency varies by program (for example, the Mindset in Motion program sends approximately 1–3 messages per day for 7 days).
• Message and data rates may apply.
• Opt out at any time by replying STOP to any message. After you send STOP, we will send one final message confirming your opt-out. Reply HELP for help, or contact us at privacy@elevatecoaching.io.
• Carriers are not liable for delayed or undelivered messages.

We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of sharing described in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, except as necessary to provide you with the messaging services you requested.

5. How We Share Your Information

We do not sell your personal information. We share personal information only in the following circumstances:

• Service providers. We share information with vendors who perform services on our behalf, including payment processing (Stripe), text message delivery (Telnyx), analytics (Google Analytics, PostHog), email delivery (ConvertKit for marketing email, Resend for transactional email), AI processing (our AI service providers), and website and database hosting. These providers may access your information only to perform services for us and are obligated to protect it.
• Legal requirements. We may disclose information if required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Elevate Coaching, our users, or others.
• Business transfers. If we are involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any change in ownership or use of your personal information.

6. Cookies and Analytics

We use cookies and similar technologies to operate the Site and understand how visitors use it. We use Google Analytics and PostHog to collect usage statistics. You can control cookies through your browser settings, and you can opt out of Google Analytics using the Google Analytics Opt-out Browser Add-on. Disabling cookies may affect some Site functionality.

7. Email Communications

We send transactional emails (such as receipts, account notifications, and program content) that are necessary to provide the Services. With your consent, we also send marketing emails. You may unsubscribe from marketing emails at any time using the unsubscribe link in any marketing email; you will continue to receive transactional emails related to your account or active programs.

8. Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your account and personal information at any time (see Section 9).

9. Your Privacy Rights

Depending on your state of residence, you may have the right to:

• Access the personal information we hold about you
• Correct inaccurate personal information
• Delete your personal information
• Opt out of targeted advertising or the sale of personal information (note: we do not sell personal information)
• Non-discrimination for exercising your privacy rights

To exercise any of these rights, email us at privacy@elevatecoaching.io. We will verify your request using the email address associated with your account and respond within the timeframe required by applicable law. You may also designate an authorized agent to make a request on your behalf.

10. Data Security

We use commercially reasonable administrative, technical, and physical safeguards to protect your personal information, including encryption in transit and restricted access to personal data. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Children's Privacy

The Services are intended for adults and are not directed to anyone under 18. We do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us at privacy@elevatecoaching.io and we will delete it.

12. United States Only

The Services are operated from the United States and intended for residents of the United States. If you access the Services from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your jurisdiction.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by updating the effective date above and, where appropriate, by email or a notice on the Site. Your continued use of the Services after changes become effective constitutes acceptance of the updated policy.
